Terms and Conditions and Transport Conditions

1. Scope

These terms and conditions apply to the commercial passenger transport service (taxi, minibus, and bus service) offered by Ferdi Gökce Taxenbetrieb under the VIP Shuttle Hamburg brand and for all services offered through the domain vipshuttlehamburg.de. Business relations between Ferdi Gökce Taxenbetrieb VIP Shuttle Hamburg and the customer are subject to German law. The contract language is German.

2. Jurisdiction

The place of jurisdiction for all disputes is Hamburg, provided that the customer is a merchant, a legal entity under public law, or a special fund under public law, or has no general place of jurisdiction in Germany, or if the place of residence or habitual residence is unknown at the time of filing the lawsuit.

3. Use of the Online Service

The offer and use of services, including registration and booking of trips, are directed only at natural persons aged 18 and over as well as legal entities.

4. Conclusion of Contract, Customer’s Secondary Obligations

Inquiries, order placement, and contract conclusion take place via the website vipshuttlehamburg.de, the installable app, or by telephone through VIP Shuttle Hamburg customer service:

4.1 Booking Process

After the passenger submits an inquiry online, by phone, or by email, VIP Shuttle Hamburg will create an offer. Once the passenger accepts the offer, an invoice will be generated. The order is considered accepted and confirmed by VIP Shuttle Hamburg after the payment is received.

4.2 Customer Reachability

The customer must ensure that they are reachable by phone no later than 60 minutes before the booked trip. For airport pickups, the customer must be reachable immediately after landing.

4.3 Customer’s Duty to Inform

The customer must promptly inform VIP Shuttle Hamburg of any circumstances that could impair the execution of the booked trip. If the customer is not present at the agreed meeting point, they must immediately contact the VIP Shuttle Hamburg service hotline (Phone: +49-40-889 550 01).

5. Scope of Service – Service Obligation of VIP Shuttle Hamburg

The service obligation of VIP Shuttle Hamburg is based on the details provided by the customer at the time of booking and the booking confirmation. Transportation will be provided according to the agreed options and includes timely pickup and transport to the destination.

For standard upper middle-class and upper-class sedans, a maximum of 3 passengers per booking is allowed. For large vehicles (Mercedes Benz V-Class), up to 7 passengers can be transported. Children under 12 years old and under 150 cm in height must be transported in a child seat, provided this was specified and confirmed at the time of booking.

The customer is responsible for the contents of their luggage. Weapons and hazardous goods are excluded from transport. The transport of animals is only allowed with prior confirmation and compliance with safety and space requirements.

6. Customer Payment Obligation

If the trip is not commenced or if transportation is refused by VIP Shuttle Hamburg due to customer-related reasons, the full agreed fee remains payable.

6.1 Cancellations by the Customer

After the invoice has been issued, the full amount becomes due; no refunds will be granted. In this case, the cancellation fee amounts to 100% of the invoiced amount.

 

6.2 Exceeding the Free Waiting Time

Exceeding the free waiting time of 30 minutes releases VIP Shuttle Hamburg from the service obligation unless the booking was made by providing the flight number.

6.3 Waiting Times Due to Delays

In the case of waiting times due to announced customer delays and depending on the availability of the vehicle, waiting time fees will be charged to the customer after the free waiting time has expired.

6.4 Prices for Additional Waiting Time

  • Cars for up to 3 persons: €5.00 plus VAT per every 5 minutes of waiting time
  • Large vehicles (e.g., Mercedes-Benz V-Class) for up to 7 persons: €7.50 plus VAT per every 5 minutes of waiting time

7. Transport Rules and Customer Liability

The customer is obliged to follow the driver’s instructions, especially regarding safety aspects and seatbelt requirements in the vehicle. The customer is liable for damages caused by improper behavior or failure to follow instructions during the trip.

8. Liability of VIP Shuttle Hamburg

Service providers, network partners, subcontractors, or employees of VIP Shuttle Hamburg commissioned by us are not authorized to make side agreements with the customer that go beyond the written contract. We accept no liability for damages caused to our clients by third parties, including those commissioned by us.

Claims for damages of any kind, regardless of the legal basis, are excluded unless VIP Shuttle Hamburg or one of its agents acted intentionally or with gross negligence, or if the claims for damages result from the absence of a guaranteed feature. In the latter case, liability is limited to the damages covered by the guarantee. In the event of injury to life, body, or health for which VIP Shuttle Hamburg is responsible, the statutory liability regulation applies.

VIP Shuttle Hamburg is not liable for service delays and their economic consequences resulting from events beyond our control, such as traffic jams, road closures, strikes, extremely bad weather, or traffic accidents. VIP Shuttle Hamburg assumes no liability for damages resulting from incorrect or unreasonably short transmission of order-related information. VIP Shuttle Hamburg is not obliged to check the accuracy of the transmitted data.

In the event of the customer’s delay, VIP Shuttle Hamburg is entitled to withdraw from contracts that have not yet been executed. VIP Shuttle Hamburg reserves the right to demand advance payments.

Payment is made in advance directly after booking. Payments can be made by bank transfer or, upon request, by credit card payment link.
